制造毒品犯罪“主观明知”的刑事司法推定研究-——以福建省龙岩市制毒案件的办理为研究样本

Abstract

最近几年，我国持续开展禁毒人民战争，通过严厉打击毒品犯罪案件，毒品形势保持稳定，毒品蔓延势头没有发展成为影响社会大局稳定和人民群众安居乐业的重大社会问题。但是，中国面临的国际国内毒品形势仍然严峻、复杂。笔者所在的地区福建省龙岩市，这几年开始“承接”了广东等地的制毒犯罪，制造毒品和非法生产、买卖、运输制毒物品犯罪现象突出。毒品犯罪，特别是利用制毒原料合成新型毒品的制造毒品犯罪，已经成为当地司法机关重点关注的案件类型。在制毒犯罪案件办理过程中，也出现了一些新情况、新问题，其中，制毒参与人员主观明知方面的辩解是主要的问题。本文试图通过对近两年所办理的制造毒品犯罪案件的研究，以案例分析方法、比较分析方...In recent years, China's sustained development of the people's war, the crackdown on drug crime, drug situation remains stable, the momentum of the spread of drugs did not become a major social problem of social stability and people's live and work in peace.
